These Terms of Use govern your access to and use of the MixByPros website and the professional music and audio services offered through MixByPros, including mixing, mastering, music production, vocal tuning, vocal editing, and related services.

By accessing this website, contacting MixByPros, requesting a quote, or submitting project materials, you agree to these Terms of Use.

1. About MixByPros

MixByPros is a professional music and audio services brand offering services to artists, musicians, producers, content creators, and other clients.

Services may be performed by André Scremin and, where applicable, other professionals involved with MixByPros.

The website may include text, images, audio examples, before and after comparisons, Spotify embeds, videos, portfolio items, service descriptions, pricing information, contact forms, testimonials, credits, and links to third-party platforms.

2. Services

Services may include, but are not limited to:

  • professional mixing;
  • mastering;
  • mixing and mastering;
  • full song production;
  • beat and instrumental production;
  • arrangements;
  • recording and editing;
  • vocal tuning and pitch correction;
  • vocal timing and alignment;
  • vocal cleanup;
  • vocal mixing and processing;
  • sound design;
  • additional production;
  • production consultation;
  • other music or audio-related services agreed upon with the client.

The exact scope, price, deadline, number of revisions, deliverables, payment terms, and other project conditions must be agreed upon before the start of each project.

3. Project inquiries, pricing, and quotes

Submitting a message, contact form, demo, reference, voice memo, audio file, or other project material does not automatically create a service agreement.

A project is considered accepted only after the relevant scope, price, timeline, payment conditions, and delivery expectations have been confirmed between MixByPros and the client.

Prices displayed on the website may represent starting prices or typical service prices. Final pricing may vary depending on project complexity, number of tracks, vocal tracks or multitracks, editing requirements, production needs, deadlines, revisions, and requested deliverables.

4. Client responsibilities

The client is responsible for:

  • providing accurate project and contact information;
  • sending organized and usable files, stems, vocals, multitracks, references, lyrics, session notes, and technical information when required;
  • ensuring that all submitted materials are legally authorized for use;
  • obtaining necessary permissions or licenses for beats, samples, loops, vocals, lyrics, instrumentals, compositions, featured artists, producers, songwriters, or other third-party materials;
  • clearly communicating project goals, references, and expectations;
  • reviewing deliveries and requesting revisions within any agreed timeframe;
  • making payments according to the agreed terms.

MixByPros and professionals working through MixByPros are not responsible for legal disputes or claims arising from materials submitted by a client without the necessary rights or authorization.

5. Ownership and rights

Unless otherwise agreed in writing, clients retain ownership of their original songs, lyrics, recordings, compositions, vocals, and other creative materials.

Services provided through MixByPros may include technical and creative contributions involving production, recording, editing, mixing, mastering, arrangement, sound design, or other creative work.

Any ownership interest, royalty, publishing right, producer point, songwriting split, master right, credit, or other commercial right arising from such contributions must be agreed upon when applicable.

Unless otherwise agreed in writing, payment for a specific service grants the client the agreed deliverables associated with that service and does not automatically transfer unrelated intellectual property or rights beyond the agreed scope.

6. Credits

Where credits are applicable, the appropriate credit should reflect the actual work performed.

Credits may include, for example:

  • Produced by André Scremin / MixByPros;
  • Mixed by André Scremin / MixByPros;
  • Mastered by André Scremin / MixByPros;
  • Vocal Tuning by MixByPros;
  • Vocal Editing by MixByPros;
  • Additional Production by MixByPros.

The exact credit format may be agreed upon according to the professionals involved and the nature of the project.

7. Revisions

The number and scope of revisions may vary depending on the selected service, package, quote, or individual project agreement.

A revision generally means an adjustment based on the originally agreed direction of the project.

Unless otherwise agreed, a revision does not include a complete change of arrangement, entirely new recordings, replacement of major source files, a new production direction, or changes that materially alter the original project scope.

Additional revisions, urgent requests, replacement files, or significant scope changes may require additional fees.

8. Delivery

Final files may be delivered through digital download links, cloud storage, email, file transfer platforms, or another agreed method.

Depending on the service and agreed scope, deliverables may include WAV, MP3, mastered files, instrumental versions, acapella versions, dry or wet vocals, vocal stems, TV tracks, production stems, mix-ready files, or other project files.

The client is responsible for downloading and safely storing delivered files.

MixByPros does not guarantee indefinite storage of source files, project sessions, stems, or final deliveries after a project has been completed.

9. Payments, cancellations, and refunds

Payment terms must be agreed upon before work begins.

Depending on the project or service, payment may be required in full in advance, partially upfront, or according to agreed project milestones.

If a client cancels a project after work has begun, any refund or outstanding balance will depend on the work already completed, time reserved, expenses incurred, agreed terms, and nature of the project.

Payments relating to work already completed, services already delivered, or time specifically reserved for the project may be non-refundable to the extent permitted by applicable law.

10. No guarantee of commercial results

MixByPros works to provide professional, high-quality music and audio services. However, no guarantee is made regarding commercial success, streaming numbers, playlist placement, record label interest, radio play, sales, audience growth, awards, social media performance, or financial return.

The commercial performance and reception of a song or project depend on numerous factors beyond production, mixing, mastering, vocal tuning, or editing services.

11. Portfolio, Before & After examples, and promotional use

With permission, public availability, or another appropriate authorization, MixByPros may display selected completed works, credits, streaming links, playlists, song titles, artist names, project descriptions, or before and after audio examples as part of its portfolio, website, social media, or promotional materials.

If a client requires confidentiality or does not want their project used for portfolio or promotional purposes, this should be communicated in writing.

12. Confidentiality

Unreleased songs, demos, voice memos, lyrics, vocals, project files, references, and private client information will be treated with reasonable care.

If a project requires strict or legally defined confidentiality, the client should request an appropriate written confidentiality or non-disclosure agreement before submitting sensitive materials.

13. Website content and intellectual property

Unless otherwise indicated, the content created for the MixByPros website, including its text, visual identity, graphics, layouts, original design elements, service descriptions, and other proprietary materials, is provided for informational and promotional purposes and may be protected by intellectual property laws.

You may not reproduce, distribute, modify, commercially exploit, or otherwise use protected website content without appropriate authorization, except where permitted by law.

Music, artwork, audio examples, embedded content, trademarks, and other materials belonging to clients, artists, platforms, or third parties remain the property of their respective rights holders.

14. Third-party links and platforms

The MixByPros website may contain links to or integrations with third-party services, including Spotify, Fiverr, Instagram, YouTube, payment providers, file transfer services, cloud storage platforms, and other external tools.

MixByPros does not control and is not responsible for the availability, security, content, terms, privacy practices, or policies of independent third-party websites and services.

Your use of those platforms may be subject to their own terms and policies.

15. Limitation of liability

To the maximum extent permitted by applicable law, MixByPros and professionals providing services through MixByPros will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of this website, independent third-party platforms, project delays caused by circumstances outside reasonable control, unauthorized materials supplied by clients, or the commercial performance of released music.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Changes to these Terms

These Terms of Use may be updated from time to time to reflect changes in the MixByPros website, services, pricing structure, technologies, business practices, or legal requirements.

The updated version will be posted on this page with a revised “Last updated” date.
